Did you know that you can’t pick fruit from a neighbor’s tree whose branches hang over your property?
The Main Justice Department of the Gomel Regional Executive Committee explained why this is illegal in Telegram.
Is it possible to pick your neighbor's apples if the branch hangs down onto your plot?
The Main Justice Department of the Gomel Regional Executive Committee answers this question unequivocally – it is impossible.
Trees that grow on plots provided for collective gardening and summer cottage construction are the property of the persons to whom these plots are provided.
According to civil law, the fruits belong to the person who uses this property legally.
Unless otherwise provided by law or an agreement on the use of this property, the Main Justice Department noted.
Thus, the fruits on a neighbor's tree, including those on branches hanging onto your property, are the property of the neighbors.
