The Borisov District Prosecutor's Office supported the state prosecution in the criminal case against Ch., born in 1991, for committing a crime under Article 364 of the Criminal Code - violence and threat of violence against an employee of the internal affairs bodies for the purpose of obstructing his lawful activities.
Ch. was accused of the fact that during the period from 18:20 to 20:27 on July 1, 2024, while in a state of alcoholic intoxication in the building of the internal affairs department of the Borisov district executive committee, located at the address: Borisov, st. Stroiteley, 14, and near the said building, in order to obstruct the lawful activities of employees of the internal affairs bodies - police officer-driver of the detention group of the police company of the Borisov department of the Security Department of the Ministry of Internal Affairs of the Republic of Belarus (hereinafter - Borisov ODO) Zh., as well as police officer-dog handler of the detention group of the police company of the Borisov ODO M., who participated in the administrative process on the fact of the offense committed by Ch., and also escorted the latter, who, reliably knowing that M. and Zh., who were in uniform, were employees of the internal affairs bodies on duty, did not fulfill the lawful demands of the said employees of the internal affairs bodies, acting on the basis of Art. Art. 23, 26, 27, 28 of the Law of the Republic of Belarus dated July 17, 2007 No. 263-3 "On the Internal Affairs Bodies of the Republic of Belarus", to calm down and stop the unlawful behavior, acting intentionally, Zh. threatened to use physical violence, demonstrating by his appearance and actions his readiness to use it, which in those conditions he perceived as real and there were sufficient grounds to fear its implementation, and also kicked M. in the left leg, causing the latter a bruise on the left shin, which is classified as bodily injury that did not entail a short-term health disorder or minor permanent loss of ability to work.
At the court hearing, the accused Ch. pleaded guilty in full, confirming the above circumstances.
The accused also apologized to the victims and repented of his actions.
In addition to the confession of the accused, his guilt is confirmed by the totality of evidence collected in the case and examined in court.
By the verdict of the Borisov District Court, Ch. was found guilty under Article 364 of the Criminal Code, and was sentenced to imprisonment for a term of 3 years.
The sentence has not entered into legal force and can be appealed and contested in the appellate procedure.
The Borisovsky District Prosecutor's Office reminds that the sanction of Article 364 of the Criminal Code provides for a maximum punishment in the form of imprisonment for up to 7 years.
