The Ministry of Labor and Social Protection of Belarus explained how to formalize remote work.
According to the Labor Code, it can be temporary (for a period of up to six months in a calendar year), combined (alternating (temporarily or permanently) work remotely and at the location of the employer) and permanent.
How to arrange remote work
As reported by the Ministry of Labor's Telegram channel, in order to formalize permanent remote work, an employment contract is concluded with the inclusion of the relevant condition or an additional agreement on changing the terms of the employment contract determined by the parties.
In the case of formalizing combined remote work at the start of work, a corresponding condition is included in the employment contract.
In case of transfer from permanent remote work to combined work, an additional agreement is concluded.
If the initiative to transfer to combined remote work comes from the employer, Article 32 of the Labor Code on changing essential working conditions applies.
According to this article, the employer must notify about the transfer to remote work one month in advance, justifying the reason.
If the employee is not satisfied with the transfer to remote work, he can quit. Upon dismissal, he will be paid two weeks' average salary.
As for temporary remote work, its registration does not require changes to the employment contract.
The Ministry of Labor emphasized that in all cases where the transfer to remote work is the initiative of the employer, Article 32 of the Labor Code applies.
