The Borisov District Prosecutor's Office supported the state prosecution in the criminal case against S., born in 1991, for committing a crime under Part 1 of Article 13, Part 1 of Article 431 of the Criminal Code of the Republic of Belarus.
Thus, S., having a common goal and a single intent to give a bribe to an official (representative of the authorities) - an operative officer of the investigative work department of the criminal investigation department of the criminal police of the Internal Affairs Directorate of the Borisov District Executive Committee (hereinafter - an operative officer of the ORR KM Borisov District Internal Affairs Directorate), on 08.04.2024 in the period from 19:00 to 19:30, being in a state of alcoholic intoxication, being in the passenger compartment of an official vehicle of the Borisov District Internal Affairs Directorate, en route along the street. Green Town in Borisov to the building of the psychoneurological dispensary of the Healthcare Institution "Borisovskaya Central District Hospital", offered the operative officer of the ORR KM Borisovsky District Department of Internal Affairs, who was on duty in the service vehicle and was responsible for ensuring public order, personal and property security of citizens in the territory of the Borisovsky District and the city of Borisov, 500 rubles as a bribe for a favorable resolution of issues within his competence, which consisted of failure to investigate her acquaintance's report of an attempted rape and failure to deliver her to the psychoneurological dispensary of the Healthcare Institution "Borisovskaya Central District Hospital" for a medical examination, reliably knowing that she did not have the proposed amount of money with her and expressing real intentions to find such a sum of money and transfer it for the commission of inaction on the part of the above-mentioned employee in the event of an agreement being reached between them, thereby creating conditions for giving a bribe, but not had the full amount of the proposed sum with her, however, the operational officer of the Borisov District Department of Internal Affairs rejected the offer to accept the money as a bribe.
By her deliberate actions, S. committed a crime under Part 1 of Article 13. Part 1 of Article 431 of the Criminal Code of the Republic of Belarus - preparation for giving a bribe.
The accused S. admitted her guilt in full at the court hearing and explained that on 04/08/2024 she had indeed offered a police officer of the Borisov District Department of Internal Affairs 500 rubles as a bribe for not conducting an investigation into her friend's report of an attempted rape and not delivering her to the mental health clinic of the Borisovskaya Central Regional Hospital for a medical examination.
Moreover, since she did not have the funds in the proposed amount, she intended to find the corresponding amount of money and transfer it to the police officer’s bank payment card, but the latter rejected her offer.
In addition to the accused’s full admission of guilt, her guilt in committing a crime is confirmed by the totality of evidence examined by the court.
By the verdict of the Borisov District Court dated 16.07.2024, S. was found guilty of preparing to give a bribe, and on the basis of Part 1 of Article 13. Part 1 of Article 431 of the Criminal Code of the Republic of Belarus, she was sentenced to correctional labor for a period of 2 years with a deduction of 25% of earnings from the main place of work for the benefit of the state, but not less than one basic unit per month.
It should be noted that the sanction of Article 431 of the Criminal Code of the Republic of Belarus provides for more severe basic types of punishment, namely: arrest, restriction of freedom for up to two years, or imprisonment for up to five years.
The sentence has entered into legal force.
