In Belarus today, 182 children pay alimony to their parents, and under duress.

In the capital, there are 56 such children from whom alimony is collected in favor of elderly fathers and mothers.

This was reported by the Minsk-Novosti agency with reference to the deputy head of the department for the organization and control of compulsory enforcement of the department of compulsory enforcement of the main justice department of the city mayor's office, Yulia Popovichuk.

According to her, most often such alimony is received by single parents aged 70 to 75 years.

How to start receiving child support

It is reported that disabled Belarusians of retirement age, as well as disabled persons of the 1st and 2nd groups, can apply for funds from their children.

The statement of claim must confirm that the sources of income are insufficient to meet basic needs (there is not enough money for food, clothing, housing, medical care).

You also need to indicate the reason for the collection, for example, loss of ability to work, receipt of only one social pension, etc.

Monthly expenses must be documented (attach a notice of payment for housing and communal services to the claim, indicate expenses for food, medicine, etc.).

If a son or daughter does not live alone, the degree of kinship and the conditions of cohabitation (maintaining a common household, being dependent, having property) are taken into account.

This is necessary to determine the possibility of paying alimony without harming the potential payer and his family members, the deputy head explained.

How much do they pay?

If the court satisfies the parent's request, all capable adult children will have to pay alimony.

As for the amount of alimony, the financial situation of not only the parents, but also the children is taken into account.

Usually the amount of alimony is between 3 and 7 base units, that is, it does not exceed 280 rubles, said Popovichuk.

According to her, the court may exempt children from such payments if it establishes that the parents have evaded fulfilling their responsibilities.

But if you have to pay, then for officially employed children, alimony will be withheld from their salaries.

If there is no work

If you do not have a permanent job and wish to voluntarily pay child support to your son or daughter, you will need to send a receipt to the bailiff every month.

There is an option when the payment request is sent to all current accounts. In this case, the bank writes off the money.

And if they do not arrive or arrive in an incomplete amount, it comes down to property in order to pay off the debt in this way.

The seizure of property is inevitable, and the reluctance to let an OPI officer in is not an obstacle; if necessary, the court can allow an inspection of residential premises without the owner’s consent, the specialist noted.

Criminal liability

If necessary, they may impose a ban on the debtor's use of the Internet and communication services, a temporary restriction on the right to drive a car, travel outside Belarus, etc.

And if alimony is not paid for more than 3 months, the person may be subject to criminal liability.

In this case, the punishment may be in the form of community service or correctional labor, a fine, arrest, or restriction of freedom for up to 2 years.

As for the duration of alimony payments, a specific date is usually not indicated in the court decision.

But if a parent finds a job or their financial or family status changes, then the amount of alimony will either be reduced or cancelled altogether, Popovichuk said.

For reference

Alimony is the means (money) for food (maintenance) that the law requires one spouse to pay to the other, a parent to a minor child, an adult child to an elderly parent, etc.
