A Belarusian woman was able to sue a company for almost 12,000 rubles for unused vacation and delayed payment.
In favor of the former chief accountant of a private company, the Rogachev District Court collected the outstanding wages and average earnings for such a delay.
This was reported by the press service of the Gomel Regional Court, noting that a former employee of the organization filed a lawsuit against the company.
In it, she indicated that she got a job at this company as a chief accountant in April 2016, and was dismissed at the end of September 2023 by mutual agreement.
On the same day, she received part of the final settlement upon dismissal – 680 rubles.
According to the plaintiff, during her entire employment she was granted only 77 days of leave, and monetary compensation was paid for only 8 days.
However, in the period from April 18, 2016 to June 30, 2023, the number of days of basic labor leave was 173, of which 96 were not used.
For a long time, she was not paid monetary compensation for these days, the press service noted.
Moreover, the delay in payment of the amounts owed to the woman amounted to 85 calendar days.
The plaintiff asked to recover from the defendant:
– 6,100 rubles – as monetary compensation for unused vacation;
– 8,400 rubles of average salary – for delayed payment upon dismissal.
The court found that at the time of dismissal, the woman had not used a total of 63 days of vacation. They had to be compensated.
This was confirmed by copies of orders on the provision of annual leave to the plaintiff, as well as on the compensation paid.
This is how the amount of compensation for unused vacation time was calculated – 4,600 rubles (based on the average daily earnings of 74 rubles 23 kopecks for 63 calendar days).
The court ruled to collect the final amount – the aforementioned 4,600 rubles – in favor of the former employee of the company.
He also ordered the recovery of 7,200 rubles of average salary for the delay in payment upon dismissal for 85 days.
